You heard wrong. They can say anything that's true. And potential employers can legally ask about the areas you mention, and probably will. Some companies have policies to limit info that they give out, but it wouldn't be illegal for them to answer questions about your attendance and performance.

I really do need to speak up on this one as a person who is contacted regarding a previous employee and in some cases a current employee. We only verify the dates, position and wages and if asked if employee is eligible for rehire.

this can be tricky as law suits have been filed and won by potential employees on this issue. many larger company will only confirm dates of employment, salary and or position.
