By law your possible employer can verify your references (past jobs included) but can only ask for dates of employment. The can ask about performance, punctuality, etc. However, you are legally obligated, as well as ethically, to tell them if you were fired and why. Since you were not technically fired you can say 'no I wasn't fired'. Dont steal any DVD's man hope you learned your lesson....good luck

Of course they can. If you ran a business and you were hiring someone, wouldn't you want to know if the person you were hiring was a thief? Who cares if it's the first and only thing you had ever stolen, blah blah blah. They have the right to call your previous employer and find out what kind of employee you are. -- I worked for a newspaper a while ago and was called several times by busineses wanting my input regarding someone who used to work for me and were trying to get a new job. Trust me, they check. And like I said, it doesn't matter if it was the only thing you ever stole it. The main thing is that you stole it. Your old employer is perfectly in the right to say that you were let go from your job because of an infraction against company rules. If they want to get specific, that's up to them.

in most states they can only ask if you worked there and if you are eligible to be re-hired. It's up to Home Depot how to answer that 2nd question, but they cannot bring up the situation legally.

Just do not list that job on your resume and your new employers won't have any way to check up about these events. List only jobs you want them to call your references for.

blockbuster for example, it's gonna care if it was your first time or not. simply -- you stole. i do think they're allowed to say what happened, considering it's why you were "let go". you can list it on your appl. but check no for can we contact your previous jobs. it may look bad, maybe you shouldn't even list it.

A former employer can say anything they want about you as long as it is true. Usually they won't because of the liability of having to prove it is true. Not listing them on your resume may work, but if you are applying for any job that involves handling money or major responsibility your employer will do a credit check and find out about the job that way. Home Depot has probably forgotten about you. I would have a friend call them asking for a reference and see what they say.
