I know you need a boating license to operate a boat on most non-tidal waters in the U.S., but what are the requirements for operating a small power boat (under 40 feet) on the ocean?

Answer:
Provided that you do not carry paying passengers or carry freight then in general the answer is no. There are restricions placed on you by your insurance companies. There is a limitation due to size of the craft when a crew member is required, but I believe that this is above 40 foot.
