wow. if a company is laying people off in that way it is probably best if you volunteer because that sounds odd and I can just see something even more unprofessional happening to those who stay. What will the employee of the month be chosen by, the color of their hair.

Oh goodness. I assume that you are joking. What a childish way to make a decision. Let's see, having employees scramble for chairs to keep their jobs while management looks on...that's wonderful. I hope you make it (though I feel sorry for the slow), but when the economy gets better, I'd look for another job. A company where management can't make tough decisions like adults isn't really going to be around for long. If I were the employees, I'd agree that no one sits down until you have assurance that the company's disability insurance is paid up...then all injure yourselves and go out on LTD in addition to your unemployment.

As long as you in an At-Will state and not under any sort of contract, it is a strange way to do it but would be legal. You may want to use your video and see if you can sell it to some reality show as I don't think anyone would believe it. But I would say that if this company is this PC and not willing to make hard decisions in this matter. Perhaps they are not willing to make hard decisions in other aspects in the business, which may be why they have to lay off 7 people. So getting "layed off by musical chairs" may actually be a good thing for the people that are in the long run.

Sprain your ankle and come into work with a doctor's note, an air cast and crutches. If they lay you off because you get beat in musical chairs you can sue them for discrimination. If they give you a free pass because of it everyone else can sue them for discrimination. Problem solved.
