I think there are a lot details missing here. Is he in violation of his visitation? Is your son being harmed? I dont think the police will just arbitrarily show up with you to retrieve your son without a very good reason and legal recourse.

If he has no legal rights to your son - then he has no choice but to surrender him... In any case - I would take the police along if you think there might be some trouble.
