He is dead but he will surely appear in flashbacks or some other manner. People who died in the first season even still appear from time to time.

I think he is going to swim through the window and get out. That is my theory and I hope its true. He's one of the main characters so I would think he has to, because what will happen with Claire? Otherwise, maybe they will just have him in all the flash backs.
