Assuming you are a citizen and/or have residency. You can not claim contribution based JSA. You can claim means tested JSA. The National Insurance Contributions (NIC) are recorded as is your employment record - they know you have been away. No pension built up in that time either. You may register and claim - they wil want to know what resources you have.

I am assuming that you are single. Have a thorough read of this: http://www.adviceguide.org.uk/england/benefits_e/benefits_coming_from_abroad_and_claiming_benefits_hrt/british_and_irish_citizens_hrt.htm Basically if you are a British Citizen and have been out of the country for a good length of time then you have to pass the Habitual Residency test in order to claim any means tested benefits. You can claim income based JSA providing you have no other income, are searching for work and have less than £6000 in savings. On the link there are suggestions to gather evidence to show that you are habitually resident (e.g. opening a bank account, registering at the doctors etc etc) You can claim straight away by applying for JSA online. They will probably turn your application down and then you can appeal. When the appeal is turned down then you can apply again, appeal and repeat this scenario until you are accepted. In our area it takes approximately 3 months until you are awarded JSA (ie. you have shown that you are habitually resident.) If Job Centre Plus tells you that you cannot apply again for a certain length of time then they are incorrect. The Decision Maker who looks at the appeal only considers the appeal on the date it is lodged (even if they are looking at it 4 weeks later) That is why you need to keep applying and appealing. If you have any difficulties then CAB would help you.

If you are British Citizen then you already have right to reside automatically (if you're not it gets complicated, speak to immigration). You still have to sit the HRT (Habitual Residency Test) which is a form you complete and it takes at least 4 weeks to complete so your claim will take much longer to process than normal and you'll be given no support during that time. To meet the HRT requirements you either need to have evidence of a strong intention to settle, e.g. property, job, marriage etc. OR have lived here for a certain period of time (there is no set limit). The more like you are to stay the less time you need to have been back in the UK, the longer you've been back before claiming the less evidence you have of wanting to settle, it's a balance basically. It currently sounds like you've only just returned and have no evidence of staying as yet, i.e. no job, property or marriage for example which means you could up and leave again tomorrow if you wanted. Unfortunately that will probably mean you have to wait quite a while before getting entitlement to JSA back again as a British Citizen. You tell them you've been away and you're committing benefit fraud which is illegal and risks prosecution and imprisonment. But feel free! They have access to your passport details and presumably your passport has been stamped and you passed through an airport or ferry terminal at some point?!
