IRS levied my bank account, any chance I can get back the funds?

They held my funds in a levy hold. Then, 20 days later, the bank sent them the money. These are my entire savings (a little over $5000). I'm not disputing the amount, but I would ...show more

Answer:
You had at LEAST 6 months of increasingly threatening notices from the IRS before the levy happened. THAT was the time window to set up the payment plan. Since you put them on disregard for an extended period of time, they were forced to resort to the levy. No, the IRS will not return the money and let you set up a payment plan. If you still owe, you can set up a payment plan to pay that off. You'd better get on that VERY quickly since if you still owe, a wage levy will be hitting your employer very soon. You've learned a tough life lesson on what happens when you ignore the IRS. I'd wager that you'll never make that mistake again. Contrary to one clueless claim, the penalty and interest rates on a payment plan are not very high. In fact, you probalby can't get a personal loan for a lower rate unless you have extremely strong credit. If you let the IRS take the payments from your bank account directly, the net rate of penalties and interest is currently less than 8% per annum. The $52 fee does drive the effective rate a bit higher, but is FAR less than "loan shark" rates as one grossly uninformed respondent seems to think. Your only option as far as your savings are concerned now is to start saving again. The IRS isn't going to refund a levy unless it was improper in the first place.

If you don't dispute that you owe, you aren't getting it back. "but I would rather have the funds back and go on an installment program." - Then you should have answered any one of the 5-10 letters the IRS sent you regarding the issue before they actually levied you. Had you even bothered to call when they sent the notice of intent to levy you could have got on a payment plan. Too late now.

I'm sure you had many chances to work out a payment program with them, cuz the levy is their final step in collecting...it's gone

Unfortunately, you can't get them back because IRS took your money to fill your unresolved tax debt. If you still owe IRS money, they may levy your assets. So try to settle a payment plan with them.

Very slim to NONE since the have completed the collection process of the $ amount that you had available at that point in time of your life. And hopefully you have learned a lesson from this about your income tax and the correct way that you should try to do take care of them each year as each year comes up in your life. Hope that you find the above enclosed information useful. 12/19/2011

LOL--- if it got to the point of them putting a Levy on your account you had opportunity to make payments. No way in Hell they are giving you back 5,000 for you to make payments on. Besides that with their loan shark interest rates and penalties added on top you'd have to pay 10,000 in installments. Leave it go and keep them current from now on.
