A married couple can either file jointly or married filing separate. THEY CANNOT EACH FILE SINGLE. If you file married filing separate and one of you itemizes, you both have to. The so called "marriage tax" was virtually eliminated by congress, so it shouldn't be necessary to "cheat". Getting in trouble ... well, you wouldn't go to jail, but ... the biggest problem is that it might take them a year or so to figure out that you cheated. They'd send you a bill for what you owed PLUS the interest and penalties. It would be a really bad idea to cheat.

The only way they can do this is by filing "married filing separately." Which is different from them each filing as if they were single. In this scenario in almost every circumstance the tax benefit is not better.

Its legal as long as you claim only yourselves like single and only put your interest and such on your form and his on his ,etc. If one is taking long form, only one can take the deductions. If there are kids, only one can take kids. Again, justlike your single but you both can not take the same deductions. Usually 99 percent of the time it is to the advantage to file jointly.,
