182 days. That isn't consecutive, that means if you are living in Spain for 183 days in any fiscal year, then you are technically a resident. If you are a resident, then legally you should pay your taxes in Spain. You, by rights have no claim to the NHS if you are from the UK. To add to the answer below, the Spanish authorities know who comes and goes more frequently these days, because when you fly, you have to fill out an API (advance passenger information). They track individuals this way.

Technically, the answer above is correct. In reality, many people stay here over 183 days per year and still don´t apply for residencia, although the authorities are getting wiser to this. If you do spend more time here than in the UK, there´s really no reason not to apply. It´s much better to things correctly and there are a lot of benefits, depending on your exact personal circumstances. I´ve lived here for 4 years, and am a resident..the paperwork was a little frustrating but it was worth it!

It is considered to be 6 months, but the accurate number of days is given in the other answers. If you are not a pensioner you will not get a residencia, these are no longer given and you will just get an NIE instead. Do you drive? If so you may need to swap licenses also. The API is not for everybody, only those travelling from outside the Eurozone effectively, which means you - It is used because if you are from England you are not really from Europe as far as Spain is concerned (neither are the Swiss if that makes you feel better).

I should like add that the fiscal year in Spain is the natural year to 31 December. You may be asking this because, like me, HMR&C have just sent you a tax return. If so, just scurry along to your local Spanish tax office and get a tax residence certificate to send to them..
