If I remember correctly, a firearm must shoot at a minimum specific velocity (number I can't recall at the moment). A paintball fires well under this requirement and therefore can not be considered a firearm.

they never killed anyone and theyr made to shoot at people it even says on the pakage but withing 200 yrds they need paintball mask

The balls would probably have to be much much softer. The one and only time I've been hit with a paint ball, it drew blood. Granted my friend has his gun pumped up too high, but mannnnn!!! Not nice. :O
