No, you are not, by federal law! If you receive any merchandise in the mail that you did not order, you are under no obligation whatsoever to return it or pay for it. You are absolutely free to do anything with it that you want. I recommend that you let the seller know what you received, and offer to return it at the seller's expense. Ask the seller what the status of your item is. If the seller sent your item to someone else, I recommend that you ask for a full refund including shipping instead of waiting for the other person to return it and then the seller to ship it again. If at any point the seller is non-responsive, open a SNAD (significantly not as described) claim in eBay.

i had this happen to me recently, i had to pay for return shipping which i think isn't fair cause the item wasn't as describe you can email the seller and explain to him/her the situation some sellers will pay for the return shipping and some won't

I agree with you. Buyer pays return shipping means if you decide you don't want it you have to pay to send it back.
