In most cases without a warrant you have to tell the person in advance they are being recorded.

Hello, OMG I recorded my ex hubby then after told my attorney I did this. She through a fit told me to destroy it and it was against our laws here in Oregon. That was 8 years ago now something like that. Now that the disabled people told me to get a voice recorder for the phone for my memory, they told me to tell them before saying anything that this phone call is being recorded. This is only for my memory, who knows in court now? Call someone in your state and ask?

It's not illegal, but I'm pretty sure you can't use it in court if you didn't tell the person she was being recorded.
