Was the decision to not use the color orange for the logo of Capital One 360 (the former ING Direct) a stipulation in the sale of the bank by ING or merely a branding decision by Capital One?

Capital One acquired ING Direct from ING and had to change the bank's name. They chose Capital One 360, and replaced ING's iconic orange with Capital One's red and blue. The question is if Capital One had to drop the orange at ING's request, or if they did it themselves to match the branding of their other banking products?

Yes it was legally required. The sale explicitly states that the brand could only used for 1 year. PS I currently work at C1.
