How much website traffic does the average consumer website get?

Should I get a music publishing license after my lyrics website gets a lot of traffic, or do I have to get it now?

  • I'm interested in creating a unique lyrics website, but I heard you have to get a music publishing license to publish lyrics. I was wondering if I can first create the website and publishing the lyrics with my features and wait until the website gets a lot of traffic and get the appropriate license(s); or, do I have to get the license(s) now? Also, how much does it cost to get the license(s) and where do I get the license(s)?

  • Answer:

So let's say I was going to borrow your car so I could go to work today. Because going to work will give me money and when my paycheck arrives in two weeks, I can pay you for the use of your car. Except I don't ask first. I just borrow it, knowing that I am willing to pay, but not talking with you about this at all. Yeah, that's illegal. For a car, we call it theft. For copyright we call that copyright infringement. Music companies have very much shown their willingness to sue any infringement. Probably because too many have borrowed their stuff and never actually bothered to pay them, let along ask permission. I would say that your plan is not a good one.

You should absolutely get a license earlier rather than later. Until recently, even the most popular lyric sites were operating without licenses and hadn't been targeted by rightsholders. This changed in 2013 after UGA's David Lowery published a http://ugalyricwebsitelist.org/, which caught the attention of the National Music Publishers' Association (NMPA), resulting in http://www.billboard.com/biz/articles/news/legal-and-management/5785701/nmpa-targets-unlicensed-lyric-sites-rap-genius-among. If you don't license your site from the beginning, you will be served a take-down notice soon enough and have to negotiate a license while you are in clear violation of copyright law.
