You don't have any rights, in this matter. They overpaid you. You admit they overpaid you. They are allowed to ask for the money back, and they are allowed to sue you for it in small claims court if you do not pay it back. What rights do you think you should have? Just payit back, and save yourself a lot more trouble.

You can choose what to do - that's "your rights". Somtimes your rights and your dignity are far, far apart. Is that small amount of $ worth your dignity?

Talk to the boss, you'll get credit for showing integrity and that's worth more than money. If it's trivial I wouldn't say anything, it might be more of a hassle for them to change than simply allow you to keep.

Yes. They can just take it out of your next pay check. Anytime you get over paid, you can pretty much count on the error eventually being found and deducted from future payments. The honest thing to do would be to tell them. If you don't choose to be honest, you should at least be wise enough not to spend it so that when they discover it, you won't experience a hardship.
