What is my sons legal right as an Autistic child?

If my sons father barely calls or visits and has NEVER paid child support do I have the right to not send him to his dad

Not yet I am in the process of filling out modification papers so I can make it a better plan. I have been sending him on the very few and far between times he asks for him. But what if he is has just gotten out of an inpatient treatment program and is in a halfway house so to speak?

lol No there is court ordered visitation one week every month until he starts school then every weekend.

child support and visitations don't have anything to do with each other, if there is a court order for visitations, you have to abide by that.. if your not comfortable, set up supervised visitations or have him visit at your home until a closer relationship is developed.

You need to go to court for child support. Too often the state does dads job.

How old is the child and what does he think about it? If the father is basically a "non-parent", why would he care? What was the agreement for visitation at the time of the divorce? What was the amount of support he had to pay? You can go to court and deny visitation it seems to me. Now, if there never was a marriage or divorce, then speak to a lawyer. It may be time to sue for back child support or relinquish his rights.

Just read your answers to the other questions. If you question his stability because of the in-patient treatment, then go to court and have the visitation changed. Residing in a halfway house is not a suitable arrangement for child visitation. I'd say you are in your rights not to send the child but you have to do this legally. It's not a nice thing to do when a person is down on his luck, but you have every right to sue for back child support.

If he hasn't paid (never) child support I doubt he's entitled to anything.

That depends on what the court order says; if the court order says the father has visitation rights, then you must abide by them. Child custody and visitation is a completely separate issue from child support; they are not linked together. If there is no court order, then until the father sues for paternity, you are not legally bound to do so.
