Should I apply for B1/B1 visa or student visa?

  • I was in US for last 5 years. I came on F-1 visa to pursue my masters, after finishing masters i got a job and my employer sponsored my work h1b visa. everything was good and it has been 4 years since i had been to my home country India. while i was in Austin, TX, couple of years ago I was arrested for DWI however my charges were dropped and I was convicted for Obstruction of highway for which I was put on probation. I was in good term of probation so my probation officer gave me consent to travel to India for a month. I asked my immigration lawyer and he told my visa processing should go smooth as my DWI charges were dropped.  So I went for the visa interview in november and before my interview visa officers were discussing my case in front of me(with mic off). i could hear they were discussing about my dwi arrest. interview went okay regarding my work details but they asked me about my arrest. I told them yes i was arrested by my charges were droped to Obstruction of highway for which i am on probation. after few mins he case me 221 g blue slip and I was asked to submit court documents for my DWI charges which were dropped.  In mean time I lost my job last month as they could not wait forever and withdrawn their petition. Since I was on probation for my obstruction of highway misdemeanor and i didnt physically report to my probation officer due to delay in visa, I violated the term of probation and there is chance of arrest warrant issued against my name( that’s the procedure) even though they know I am stuck because of visa delay/issues. So i emailed the mumbai counsalte office and asked them what should i do as i need to appear in front of judge and clear my charges as well as wind up my stuff. this is there response. Can you please advise should i apply for traveler’s visa or student visa(want to go for MBA). as its difficult to get the h1 job in my field from here in India. I can show strong ties to come back to india as I have my family business here. REsponse “Dear Sir, Unfortunately, if your position of employment is no longer guaranteed by the employer, you will have to reapply for another visa for travel to the United States. I encourage you to reapply with another approved petition should you wish to work in the United States. The prior charges that came up during your visa application process this time have been cleared up, so, if you reapply, the process will likely go more smoothly for you. However, since the petition that is the basis of this application is no longer valid (since there is no longer qualifying employment), you must reapply with another approved petition and pay the required visa fees. We hope this information helps, and sorry that you lost your job because of the delay in the processing of your visa application. Sincerely, Consular Information Unit”

    Well, do you want to go to the U.S. just to clear up the charges? Or, do you want to attend school? If it's the latter, you're going to need an F-1 visa. I don't think either visa classification is necessarily preferable to the other, it really depends on what you are looking to do.This answer is not a substitute for professional legal advice....
