If a person has an email hacker's IP address can they get a court order to find their address?

If they have the hackers I.p address the court can have him arrested. It depends on what the hacker did and where the ISP is. If a hacker in the US violated US law, then you need to convince the government chase him or file a civil case for damages. If no law was broken then the civil case is your only option. In practice, some ISPs will cut off a user if they receive a well documented complaint showing serious or repeated misconduct. It is nearly impossible to take action in the case of foreign ISPs especially if they are in Eastern Europe or Asia.
