Is it illegal to leave the state of Missouri with my children for good cause, even if I am the custodian parent?
-
I am wanting to leave the state of missouri to move to the state of washington for good cause. My ex boyfriend is the father of my two children and does not want me to leave simply because he wants to be with me. He has been abusive in the past and controlling and I want to get my kids and my self out of this state to better my kids and my own future. I have family in Washington state. I want to leave but im scared he can press kidnapping charges on me. I am the custodian parent. And he recently got charged with domestic assult, and I dont think its fair my children have to stay here, because an abuser has the right to hold me back.

Answer:
I applaud you for having the strength to leave an abusive relationship and the courage to move and better your life (as well as your children's)! If you are legally the children's guardian, you can move anywhere you want, any time you want without any repercussion. It sounds like the sooner the better too! You sound like a wonderful mother, so go for it and I'm wishing you the best of luck!!!

I'd contact an attorney first. Although you see this as a good move the courts may not. The entire system is set up for the criminal by criminals, it is unbelievable. Just make sure that all your Ts are crossed & your Is dotted. You have physical custody, but do you have full 100% legal custody. There's a difference between the 2, if you do have both you should be okay. But for your children's sake make sure that there is no way that your EX. can charge or accuse you with anything

It can be tricky to move out to another state since the father of your children is in another state. You may need to give a 60 day notice and get a written consent from the father of your children. If your ex does contest your request for custody relocation, you should be ready to face a full custody evaluation. Does he have visitation rights? He could sue you for more visits. Consult a lawyer and get a PDF.
