How can I get the courts to allow me to move back to California with my daughter when my ex and I have joint custody?

My ex and I have joint custody of my daughter. He is behind $600.00 in child cupport(not much I know) But only has her every other weekend and doesn't make any effort to be in her life beyond that. I have agreed to let him have her 1 day per week or however much more time he wants her but he hasn't. He doesn't make it to her school events, or her out of school sporting events. He doesn't seem like he cares all that much but seems it is more of a control factor. He is not a bad person. But my daughter and I would be a lot happier in California where all of my family lives and this means she would have more time with them and in the end more time with him. Consdering he would get her every summer and I would pay to have her fly back to see him every Summer and every other Christmas. I think it would benefit him more as well as my daughter considering the fact she would have more time with him in a constant period of time. He will fight me on this decision. Please any advice is helpful.

I think the best thing for you to do is to try and talk to your ex before you take the matter to court. The two of you can come up with a plan that works for both of you. Don't forget that you have joint custody so the chances that the court will let you take her away are thin. If he doesn't co operate I suggest that you get a good lawyer.
