How do you set up a trust fund for an inheritance?

Am I legally able to gain acces to my Aunt's Trust fund that she set up for me? (Please help!)?

  • My aunt set up a trust fund for me to have for college, there is a good amount of money and I was going to use it to go to school in England for four years. She said specifically that it was meant for college in England as well. My mother has been handling the money and talking to the people in charge of the trust. I have been shut out of it mostly and don't know much about it. All I know that it's in my name, and no one else. Now here is the problem, my mother and I have fallen out, so as a punishment she has taken away me going to college in Manchester. I have gotten into the college and everything is ready besides the money being sent. I know she won't give me the emails to the people in charge of the trust. So I need to know legally am I able to access the trust by myself and send the money to the school? Also I'm 17, but i turn 18 in August 17th (but i start school September 1st) I just need what control I have over this situation. Thank you very much!

    I suggest you consult an attorney to ask for a court order to force your mother to provide a copy of the trust to you and to the attorney. Then the attorney should be able to get an order to force your mother to turn the money over to you.

Most trusts are designed to lapse at 21. Since you are 17, it's doubtful you can get access anytime soon. You should make alternate plans. This could include working for a year or two and then going to college.

Since you are still technically a minor, there isn't much you can do As soon as you are 18, contact a lawyer and give him all the information you have. Your mother is probably trustee of the trust fund. You could also go in person to the people in charge of the trust, that would be a bank, investment company or attorney. How do you know your Mum won't give the money to the college? As soon as you are 18, you should be legally entitled to information.
