Ebay Buyer Sue seller ...! PLEASE HELP?

  • Hi, I am a positive rated seller on eBay. I recently sold a rug on there for about 9000$. the listing did not have return policy and after interested buyer kept messaging me and asking me that he is interested in the rug BUT need return policy, I accepted 3 days return UNDER the fact that: ANY damage or Stain on the rug will not be accepted for refund. And rug should be returned in NEW condition as it was sold. Buyer accepted it. I took pictures from rug before shipping, and then packaged it and shipped it carefully with FedEx. after buyer received the rug, he send me an email the next day saying that he does not want the rug because its color does not go nicely with his floor! I responded saying that go ahead and package and send the rug back to me, and after I receive and inspect it, I will issue him full refund. After few days, I received the rug, BUT as I opened it, 3-4 sections near center and corner of the rug Showed signs of washed and yellow stain. I emailed the buyer right away and asked him whets going on and if he poured something on it. I took pictures from those spots and send it for him. HE flatly denied any damages and even when I send him pictures from those damaged area, HE SAID THAT HE DOES NOT EVEN SEE ANY DAMAGES.!!!! Before this I was ready to refund his money, but with damages, I could not resell it under new condition. He escalated the case from eBay resolution center. I took the rug to an experienced carpet repair/wash company, and after they thoroughly inspect the rug, they told me that stain seems to be urine and that it’s maybe impossible to ever fix the color of that area. They told me that if I want them to wash the rug, it cost 600$, BUT they don’t recommend this, because the rug is VERY delicate and washing the whole rug might even damage the whole thing. As upon eBay request, I also filed a policy report, and took pictures from damaged section of the rug and made reports and send repair estimation to eBay. after almost 2 weeks deleaing with eBay resolution center back and forth and eBay REP giving buyer 72 hours to response to two options: 1- he can pay 600$ for washing carpet or 2- I returned the rug back to him, BUYER did not respond!! EBay rep, waited another 4 days for buyer to respond, but buyer did not respond! so, eBay ruled in favor of me on 21st and told me to send the rug back to him with signature confirmation number and they will close the case after buyer receive the rug back. So, long story short, eBay closed the case and they did not issue any refund to BUYER. After few days, I received a letter from buyer's attorney suing me over this, stating misrepresentations and fraud!! I was just wondering why this block head damaged my rug, and then after receiving it again, suing me for 9000$ + 2500$!!! Any suggestion what he or his attorney might have in mind? Highly appreciate it!

    Sounds like you need to contact an attorney you need to unplug your computer from the net. Down load all the pictures you have of Before and afters Use the pictures that you used to upload to ebay. To show that it had no stains. and the pictures of the rug with the stains. Burn them to multiple CD's and put them into a fire proof safe or safety deposit box (just to be safe). Get all the documentation you can and contact an attorney on Tuesday. (they will be closed Monday). Ask him about counter suit over legal costs as well... You should probably also contact Ebay about it as well. I'm sure they would like to know about this.
