Driving without a license in California?

In the state of California, if an illegal immigrant is arrested for driving without a license? PLEASE HELP.?

  • My friend was caught driving with out a license, got arrested, and is now sitting in a county jail. He was driving completely fine on an empty rode maybe going 25mph if anything. A forest deputy or sheriff of some sort pulled him over, I honestly have no clue as to why though. Of course being under his circumstances he was beyond nervous and started fidgeting and taking off his seat belt and jacket. The officers then demanded license and registration which he didn't have a license, arrested him and then said he may be at risk of being deported. After he got booked into county jail under misdemeanor, we called the facility and asked and they too said the same thing. My question is that being that he wasn't driving recklessly, or could have possibly given the officer any possible reasonable suspicion, and has been living in the U.S. for about 4 years now with no criminal record, could he be at risk for being deported back or is there somehow we could change that or some loop holes to help?? PLEASE HELP.

  • Answer:

if he's not in the country lawfully, he is always at risk of deportation. He does have a right to due process and will go before an immigration judge, who will make a final decision.

If there is an immigration hold on him there is nothing you can do. He's an illegal alien and therefore has no business living in the USA. He will be deported.

No he is breaking the law being here and now not even following the laws? If he hit someone who would pay for it? He has no ssn# so he is gone.

Depends on where this happened. In San Fran or L.A. he would have been given free housing vouchers, a food stamp card and a party then sent on his way. If he got nailed in a county that isn't in flagrant disregard of federal immigration law he's probably going to find himself on an immigration hold. Lucky for him this particular federal administration only deports mass murderers and child rapists.

No, he's screwed.

If they know he is illegal and he isint in San Francisco he will have and ice hold and will get deported. This is good news so don't act like its a negative thing.

If he is here illegally, of course he is at risk for being deported, and he should be. Bet he didn't have insurance either. A genuine good person doesn't thumb their nose at the laws of our country no matter which laws they are. He isn't "forced" to drive without a license, that is a lame excuse. Don't know why it is so hard for people to understand that if you do not have a license, you are not supposed to be behind the wheel of a car. What "nice" things would you like us to answer with? There is nothing nice to say about someone who disrespects our country by being here illegally and then ignoring all the other laws once they get here.
