Can the retail store still sue me?

Can I sue this store for the supposed lying to me about my money over a month?

  • Man I forgot to take the extra cash after purchasing something using the self cashier machine with my card, and took the item and rushed out without expecting the cash to come out soon to be on time for getting a ride - I was not fully awake because it was about 5 AM. When I got back to the store on the evening to ask about it, I described what I was wearing and told the time and that a staff was watching me processing the purchase. But the person responsible said I didn't appear on the security camera video and only a few other people were captured. I suspected she was lying, because the money obviously came out literally in seconds after I ran outside, and the staff next to me must have noticed the cash coming out (it makes a mechanical sound and flashes a green light) I guessed the staff took my money, and the manager tried to protect him. So, just in hope to get my money back, I left my name and phone number in case. It happened on the mid April. So, just a few days ago (late May), I made a call to the customer center, and with my card number and the date, I could find out the exact record of what I did - the same I was telling the manager. The person on the phone said she was going to report it to her superior, and the conversation with her will be sent to the manager of the store at that location to give me feed back in 48 hours. I got a response from the general manager of the store the next day, and he said the cash was reserved for me to take back. I said I had no time to get it back sooner, and told him I would get it later, because I wanted to check if the store admitted the incident, and to consider about suing the store or the headquarter of the store for neglecting customer care service, and getting away with it by just saying a few lying words. If I found out the security camera video showing the employee getting my money (and the manager covering the truth with lies), can I sue the store manager?

  • Answer:

The question isn't whether you can sue or not. It's whether you can win. Yes, you can sue. People sue for things equally as stupid as this... in fact moreso. But you won't win. The manager isn't negligent and it's not their responsibility to get you the money back that you already admitted to "forgetting about because it was 5am". Plus, they offered the money back to you and you can't seem to find the time to go get it. Just go get your money and consider yourself lucky that you even got that back.

You potentially have a case, because you would be on CCTV and the manager lied about not seeing it. However, you won't settle out of court for much and it would cost a lot to make a lawsuit. Also, a large store would probably have good lawyers as well. Personally, I don't think it is worth taking them to court, as the cost of losing could be as much as £5000.

No. because it's like if you found money laying on the ground and taking it.

It is going to cost you $3,000 to start a lawsuit that you may not win. How much money are you talking about? People do this everyday. They leave their change some place. This week I went to the library to make one photocopy. The cost was ten cents a copy. I put a quarter in the machine and made my one copy. When I punched the button for my change, three quarters came out. I put in my pocket and left.

Just be happy ur actually getting ur money, becuz it was you who left the money, its not their fault u was rushing, but yes u can sue but more than likely loose the case, then loose more money for lawyer and court fees...
