If you sync a iphone 3g with a sim card in will AT&T and Apple see its in use?

Well, I have a iPhone 3g and I know that if you take out your sim card while syncing your iTunes AT&T and Apple don't see that you are using the iPhone, but heres the thing, i got new ringtones and the phone wont let me download them unless I have the sim card in, will the company be able to see that the phones in use if you plug it in, or is there some other way to get the ringtones from my iTunes to the phone???

The answer to your question is NO! Either way if the sim card is active for att or not it should not interfere with your sync and if it is not active then just leave the sim card in a sync. Hope this helps.
