Can a 16 year old work in a body shop?

Hello, this question is not about me. Basically, my wife's father is going to force her 16 year old brother to work with him in a body shop. Cars that have been smashed in wrecks come in and they have to fix them up like new dealing with a lot of heavy machinery. So, the 16 year old does not want to go work in the body shop and would prefer to get a real job (which I would help him with). However, the father is going to basically force him to go in with him and work in the body shop 6 days a week from around 9:00am to around 10:00pm or 11:00pm (on average 12 hours per day. Yet another thing is that he wouldn't even be paying my wife's 16 year old brother (so he says right now), and if he does, it will probably be around $25 a day (less than $5 per hour). Can he even do this? The 16 year old didn't do anything wrong really, he isn't the best student but he still does okay in school (C average), he wants to get a job now that he's 16 and it's summer vacation, and he has never been involved with drugs / alcohol.

I doubt very much that OSHA allows a 16 year old working in a shop. Get the kid in your car right now and get him a job today. Then he won't be able to work with his dad.

Well $5 bucks an hour for a teen is a pretty good deal considering he doesn't have to pay rent. I guess he could aks for more pay but I doubt he'll get a "real" job in this economy. I'm guessing the teen doesn't want to work at all and you misunderstood him.

Yes, a parent is allowed to put his/her minor child to work in the family business. Now, there are still some restrictions about the machinery that the minor can operate, but if the minor is working under the parent's supervision, then the laws are less strict. It will depend on which state this is in. Also, this minor child is not entitled to ANY money. What's more, even if he got a job at McDonald's or someplace similar, the parent could take ALL the money that the minor earns. There might be some specific parts of this that are against the law, but generally speaking, yes, a parent can force his/her minor child to work in the family business, without paying the child at all. I'm not sure about the hours, but if this is during the summer and the child is not attending school, then the child can work for quite long periods of time. Getting a C average is not "doing OK", it's doing rather poorly. Doing OK is getting As and Bs. The father is probably trying to impress upon this son that if he doesn't apply himself in school, then he can look forward to hard, dirty work for the rest of his life.
