Applying for British Citizenship.

Age limit for Australian applying for dual Australian/British citizenship?

  • I am an australian citizen born in Australia in 1994 to a British born father who moved to Australia at 3 years old. My parents were married when i was born and my father still had his British citizenship at my birth. I understand this makes me a british citizen by descent? I would like to apply for a dual citizenship, but am not sure how to go about this? also, i heard that a british citizenship by descent expires once you turn 18 if you do not apply for a passport before then? As i will be turning 18 in 7months, i was wondering if this was true? and if so can i still apply for dual citizenship? Thanks for any help :)

  • Answer:

Your father was a British citizen 'otherwise than by descent' when you were born and he was married to your mother so you are and always have been, a British citizen 'by descent' and there is no need to apply for citizenship now or at any time in the future. http://www.ukba.homeoffice.gov.uk/britishcitizenship/othernationality/Britishcitizenship/borninukorqualifyingterritory/ Your father's citizenship 'otherwise than by descent' http://www.ukba.homeoffice.gov.uk/britishcitizenship/othernationality/Britishcitizenship/bornoverseas/ Your citizenship 'by descent' British citizenship does not expire - once a citizen, always a citizen unless you deliberately renounce your citizenship. At any time and at any age, you can apply for a British passport. Just remember that you must always enter and leave Australia on a Australian passport so you will need passports for both countries. http://ukinnewzealand.fco.gov.uk/en/help-for-british-nationals/passports/how-to-apply/australia Applying for a British passport from Australia - applications are processed in Wellington NZ but you lodge them at selected Australia Post Offices I am also a British citizen 'by descent' through my Scottish born father and got my first British passport when I was in my 40s.

First of all don't worry about the age limit: once a citizen, always a citizen. What's probably getting you confused is that under some circumstances children can only be registered as British citizens up to the age of 18. It doesn't apply to you. You don't have to do anything to claim citizenship, you just apply for a British passport to exercise your citizenship. You will need your birth cert, your father's birth cert and his British passport at the time of your birth and your parent's marriage cert.
