Do I need a lawyer for this? Car accident question.?

I was involved in a car accident. I was rear-ended. The driver admitted fault, and within a week my car was totalled out and I had my property claim taken car of. I suffered a Cervical/Neck Sprain which I am now goin to phyical therepy to help me fix it. So far the other driver's insurance company is workin with me. They are taking care of all of my bills. Since they seem to be working fine with me I haven't bothered to consult a lawyer. My question is...should I consult a lawyer or just wait and see what happens? I have never been thru this before so if anyone has any advice to give me it would be so helpful. Thanks in advance.

Why would you consult an attorney? The other company is handling it and no where in your question do you say they are not treating you fairly. Sure, you can hire an attorney. But an attorney is going to take 1/3 of your settlement as his fee. Some add expenses on top of the 1/3. As it is now - the pie gets cut into 2 pieces: medical providers and you. If you hire an attorney, the pie gets cut into 3 pieces: medical providers, attorney and you. So....would you rather have 1/2 of the pie or 1/3? Personally, I'd just keep working with the insurance company. You can always hire an attorney latter if you decide it's worth paying them 1/3 of any settlement you get.

In many states the statute of limitations to file an injury case is one year, so if you are not done treating as the year approaches you may have to file a case to preserve your rights. Otherwise the insurance company will not be obligated to continue your treatment and will quit paying for it. Your county bar association probably has a referral list of personal injury attorneys.
