Wat is the difference btwn MURDER n Manslaughter in singapore?

What's the difference between manslaughter and 2nd degree murder?

  • My co-worker recently got charged 2nd degree murder for beating someone to death. Most ppl say it's manslaughter. I want to know the main difference between the two terms and which will be a lesser sentence.

  • Answer:

All definitions of murder require malice, whereas manslaughter does not. Most Murder 2 charges are filed when there is a reasonable belief that the offender had malice toward the victim, however did not intend on killing the person, yet their actions resulted in the death of the victim. For example, if the offender punched someone in the nose who they hated, and the solitary punch resulted in the death of the victim. Most reasonable people would assume that a single punch is not likely to kill, therefore the single punch does not amount to intent. Voluntary manslaughter is usually reserved for offenders who had malice toward their victim and intent to kill, yet mitigating circumstances applied, like for instance the victim was the lover of their spouse, and the offenders actions were a result of the offender not being in the right state of mind. Involuntary manslaughter is usually reserved when the offender had no malice, and had no intent, yet their actions were so negligible that it resulted in the unlawful death of another.
