Is a provisional worker a contract or permanent worker?

Question about contract worker laws (Real Estate)?

  • I have a friend who was an apartment locator for an individual broker. The broker lost his company and now is finishing up the last payments to his agents. She was hired as a contract worker and now the broker is throwing fits paying what is owed to her. She quit working for him about a month before he stopped doing business. When is she legally due all that is owed to her. I know here in TX if you quit your job the employer is to pay you all that is owed by your first payday or if you are fired they are legally required to pay you that day. Is it different with contract workers? She is paid when the apartments pay the broker, if she knows she is due say 2000 is he legally supposed to pay that by her next scheduled payday or does she still have to wait for all the properties to pay him? There is nothing in their contract about ending the contract so now she needs to know what the standard laws are in collecting her money.

    Contract workers are NOT employees, they work for themselves they file their own taxes, if she wants her money she has to go to court there is no state or Federal agency that can help
