What is a bank loan?

I had loan in Dubai and I lost my job, now I am in India, Bank is filing a legal case. What to do?

  • Two years back I was in UAE. While working there I had taken a Personal loan (50000 AED) from bank. Unfortunately I lost my job and back to India.Before leaving I had paid 25000 AED to bank. After return to India, I had informed to Bank that this was the situation and I am not in position to pay now. But I will pay the entire amount and requested not to charge the interest. After 2 years I have requested to Bank representative that I want to re enter UAE again for a job. He suggested me (Through Mail) that to pay 20000 AED and bank will withdraw the case against you. Also bank will provide NOC. After several request / Correspondence Bank agreed to make it 3 installment (i.e. 10000 + 5000 + 5000). Again I paid 10000 AED. And asked to give clearance / NOC to enter UAE. Also asked to send me the said amount receipt in a proper bank document. But every time they are send only e mail that 10000 AED received. But not sending a hard copy of receipt nor scan a copy. Now they are asking 10000 AED in single payment. As per discussion if I will pay again 5000 AED then they will issue me NOC but again this is in mail only. I am asking to send me in Bank letter head that if I will pay 5000 AED then Bank will allow me to re enter UAE and balance 5000 AED I will pay in subsequent month and further there will not be any dues. After several request they are not giving me in writing. Very recently I have received a mail from Bank legal department as follows:- "This correspondence is with regards to the Credit Card that you have availed from Bank, UAE. While you were employed in UAE & as per the terms / conditions you had explicitly agreed to repay overdue as per the terms without any default whatsoever. We would like to inform to you that there’s an overdue amount of AED 36,000. Your Credit Card account mentioned above as on date and at the time of follow up it has come to notice that you are not available / contactable in any of the UAE addresses or contact details provided in your application form nor the home country address provided by you at the time of availing the facility. You have not intimated the Bank in writing on any change in contact details & address for contacting you for the over dues and as per our information you are currently based in another country. You are requested to note that there's a police case filed against you in UAE for cheque bounce towards repayment of the credit card account & in the event of no payment coming in on the account we would be further initiating action other than moving Interpol and also intimating the concerned authorities on the pending police case against you in UAE. Unless we receive letter of intent from you to settle the above account within thirty (30) days upon receipt of this letter, the Bank will exercise its right and initiate legal proceedings by including your name in immigration TRAVEL BAN lists against your passport. And if you are currently working and holding a WORKING VISA, the same shall be subjected either for revocation, cancellation and eventual imprisonment or detention as the case maybe to recover the outstanding amounts without any further notice to you. I hope you will give your full attention to this important matter and awaiting for your soonest revert Please contact us if you need any clarifications or reply to this mail at the earliest to avoid proceeding towards filing Interpol". One Points I would like to add,(1) while taking loan there were two guarantor. I am not in position now to pay this amount. Can any one suggest me what could happen? Or how to get out this problem?     banks here in uae are hard to trust. you must keep the end in mind before negotiating. am not in leagal but this is what i willl do take out printouts of all the email correspondence do a background check on the representative you were dealing with to make sure he was a bank employee. hire a good local lawyer. and you should win the case as stated and agreed by your post above.
