How can people with criminal records ever get a good job?
-
I'm 25 and a college graduate. I have a DUI from when I was 19 and an MIP from age 18. In my state there is a statute that says a DUI is on your record for life so it will never go away. I used to disclose my crimes, being honest, on the applications but no one would call me for interviews. I later changed my game plan and said "no" under criminal convictions and soon got a lot of interview requests. I was just offered my dream job but then it was rescinded because I lied when asked if I had a crime. Yes, it makes me look like a liar and the argument they have is it is not the crimes itself but the lying but had I disclosed them on the application would they have ever called me for an interview? Yes, I made mistakes as a teen but how am I ever going to be integrated into society? I'll be a 50-year-old woman and still have to disclose that I had a beer in my college dorm room and how I drove drunk when I was 19, yes a bad mistake but I never even crashed or hurt anyone. It kind makes me lose motivation and want to be lazy lol. Also, should I do social networking try to get a job through successful friends that own businesses or are high level managers and know my character so they will hire me where strangers won't? Thanks so much.

Answer:
Welcome to the New America. What is truely sad - is that one aspect of American culture that historically made it a great nation was the notion that the USA was a land of 2nd chances, where a person reinvent themselves and start over again. One could leave one's European past behind ans start afresh in the USA, and if one messed up in the USA one could move to another state or go West to start anew. America was the land of 2nd chances, where one's future was more of concern than one's past. Today the USA has become too intrusive into the private lives and histories of its citizens. Certainly, I don't want pedophille teachers and antisocial police officers, but by the same token I don't want myself or my neighbor who made a relatively mild mistake - such as a dui or disorderly or shoplifting charge in their distant past - to be stigmatized for life and denied the right to employment. Some of the best folks I've known are people who made past mistakes and learned from those mistakes. In fact, I am more suspicious of some folks with unblemished records because they be just a mistake yet to happen or someone who has just not been caught to learn their lesson... They might also lack the risk taking gumption of creativity that separates a conformed employee from a more creative one.

Some states have procedures to expunge or set aside or recategorize a felony (if it was felony dui) as a misdemeaner. Expungement entirely removes the criminal history, and you can say report as no prior conviction (but check the law in your state). Set-asside means that you've completed all the penalties for the conviction and can't be further penalized. its not clear what this requires on reporting. recharacterizing as a misdemeaner will let you avoid questions about felonies, but not misdemeaner questions. lying on an application is a bad idea. Today most companies do background checks, and records are more complete then ever. You'll just get caught in a lie.
