When minimum wage is 8.25 an hour is it legal to make 7.75 an hour?

  • I live in Illinois and I have been working my job for nearly two months. I make 7.75 and hour and minimum wage is 8.25 an hour. I am only scheduled for 20 hours and 45 minutes but I also get off work at least an hour early everyday sometimes more than an hour early everyday. I used to be scheduled for over 25 hours a week too. But everytime a new shedule is released my hours get cut. On my last pay check I only made 212 after taxes and had worked 33.25 hours in two weeks. Is this legal???

    If you're under 18, then yes, you can be paid 50 cents an hour less than minimum wage, which makes it $7.75/hr. Sucks, but that's the law in Illinois. EDIT: The only way this is illegal or something to pursue with the labor board is if you are over 18. $7.75/hour is more than the federal minimum wage of $7.25/hr, and is the legal minimum wage in Illinois for minors. I've been working in and hiring people in Illinois for almost 15 years now. It depends on how many employees work there. Illinois minimum wage only applies to companies that have more than 4 employees (not including family members). Otherwise the federal minimum of $7.25 would apply. If they do employ more than 4 people, you should probably talk to your state's department of labor to find out how to file a complaint. We need to know what your income is before taxes to determine what your REAL wage is. If you are a tipped employee you can earn less and like the other person specificed you can earn less if there are less than 4 employees. I don't believe that Illinios has an under 18 wage.

I would imagine that it's illegal. But you'd need a lawyer, and they're expensive. Go to your states legal website (look for something called "Illinois general statues") and study the laws.
