Can you file bankruptcy on a garnishment?

To file for Ch. 7 bankruptcy, Do I need to gather my cc, debt collectors, garnishment info?

  • I have like like 5 credit cards that went over to collection and a few went to judment wage garnishment, etc and also have negative on chex system so cant open a checking account anymore. Will I need to gather all that information before I file for chapter 7 bankruptcy? My income is $1130 per month from SSI and SSDI disability, and all debt is more than $25k Will I need to gather all information or will the bankruptcy attorneys do that for me?

Credit reports are free at: http://www.annualcreditreport.com - This is the real free site. - SSI and SSDI disability cannot be garnished for private debts. If this is all the income you have, then you are judgement proof as they are legally powerless over you. In this case, there is no real need to file for Chapter 7.

Your attorney should tell you what to do. If he/she is not, then I would consider not filing bankruptcy. Haven't you considered paying off your debts? I know of a few people in your situation that are making about the same amount of money and are paying off their debts of a similar amount. Perhaps you could talk with a debt management company.

I suggest you try to negotiate a payment plan for the credit cards. Work with someone from NFCC (nfcc.org) who is licensed for this. Most banks will work with you because they know that if you go bankrupt they get nothing.
