UK Dog Law - Any expert advice please?

  • Please could anybody confirm in UK laws below: That a dog owner allowing an unleashed dog to come onto the drive (without permission) and barking and snarling so much it scares us back into the house for fear of attack is indeed breaking some of these laws? It scares my 83 year old mother in law terribly. We no longer free range our poultry because this owner has not got their dog under voice control and we fear the dog will kill them. Anybody really know their stuff regarding these dog related laws? Under The Road Traffic Act 1988 It is an offence to have a dog on a designated road without it being held on a lead. Is this any public road? Including minor ones? Dogs (Protection of Livestock) Act 1953 That a dog must not worry (chase or attack) livestock (cattle, sheep,goats, pigs, horses and poultry) on agricultural land and the farmer has the right to stop your dog. Animals Act 1971 dog owners could be liable for damage caused by their dog under this Act or under some degree of negligence. Dangerous Dogs Act 1991 (section 3) It is a criminal offence (for the owner and/or the person in charge of the dog) to allow a dog to be ‘dangerously out of control’ in a public place, a place where it is not permitted to be, and some other areas. A ‘dangerously out of control’ dog can be defined as a dog that has injured someone or a dog that a person has grounds for reasonable apprehension that it may do so. Something as simple as your dog chasing, barking at or jumping up at a person or child could lead to a complaint.

    You have good cause to complain to police. Given the spate of DD attacks, I suspect they'll act. The owner is being most irresponsible. Tell him that if the dog comes onto your property again, you'll impound it and call the council.
