Hi guys, please help me... Problem with the Ebay seller :(?

Hi guys, please help me... I bought a dress on ebay (from a top-rated seller from China), (paid for it and then waited for two months for the dress to get sewn and shipped to me). When the dress finally came to me it was AWFUL! It was a complete mess and absolutely not as described! I took the pictures of it and was trying to contact the seller for several times, but he didn't answer to me till I opened a case in Resolution center. When he finally answered, he said that he would do the refund when I send the dress back and provide him with the tracking number. So I did it, I sent the dress back and gave the tracking number to the seller. After that he disappeared again and did not answer to my questions about refund! Ebay is sending letters to me asking if I want to escalate the case to the Customer Support: if I won't escalate the case it will close by the end of May and I will not be able to reopen it even if I will not get the refund :( I wrote several letters to the seller, and he answered to me only when I said that want to escalate the case. The seller now says that he will do the refund only after receiving the dress. But estimated delivery to his country is 30 days and my case will get closed by the time he gets the dress :( Please, tell me what should I do? Should I escalate the case? And how does it work (I mean the Ebay Customer Support)? Thank you very much!

You need to 'escalate' now or your window of time for making a claim will expire. Ebay/PayPal will want the tracking number, and very little else. It is a simple process, with (unfortunately) limited communication from eBay/PayPal. I don't know why you'd be so waffly on this -- open the dispute NOW or your money is gone. Leave NEGATIVE feedback, not neutral, mentioning condition of dress and lack of communication. Always read feedback carefully; "top-rated seller" means a certain volume of sales and not totally screwing up; it's not much of a guarantee. A lot of "top-rated sellers" have plenty of negative feedback; always pay attention to that, and realise that if you have any problems with that seller, you won't be treated any better than the people who were burnt before you. Don't bother writing back to the seller; just escalate and leave a negative and move on. If you encounter a problem again and the seller is not immediately happy to make things right, don't negotiate further with a bad seller; let eBay/PayPal do it for you.
