What Is Deposit Insurance?

Can I get my insurance deposit back? I gave the landlord the deposit three days ago. I never moved in.?

  • I decided to rent a room three days ago and I gave the landlord my insurance deposit. But today I found that I have to move to another state. I never moved in. We didn't sign any lease. So do you think I can get my insurance deposit back?

  • Answer:

You'll get the security deposit back, but you won't get any RENT back, if you paid it. He's entitled to keep that rent (or take it from the security deposit) since he took the unit off the market for YOU.

There is no grace period. A holding deposit is not refundable. You can always ask for it and see if they agree but there is no legal requirement that it be returned to you. It doesnt matter if he finds another tenant, this is not rent. If you went to court, these are his damages for having to finding another tenant and he may lose a month's rent. Unless it indicates on the receipt that it is refundable, when you change your mind, you lose it. That is the policy of most landlords.

When you give a security deposit what you are telling the landlord is "I'm going to move in, don't rent this to anyone else". So if you don't move in you usually don't get it back. It will depend upon the landlord if they want to give it back and it doesn't matter if they'll find another tenant soon or not. Count this as a lesson learned.

What agreement did you sign? And, if you didn't sign an agreement, then why would you give someone money without an agreement?
