Not getting my holiday pay because i didn't work my notice?
-
I was working at Mcdonald's for six months, and i got offered a new job somewhere else, so i left and took it. I enformed one of the Managers that i was leaving and that i wasn't working any notice because i was on casual hours and had signed no contract. So basically one of Mcdonald's managers rung my new workplace and said to me, You didn't let me know and i deal with shifts, i told her i let a manager know as she wasn't in the time i came in to quit, my new job started very asap. So she said you won't be getting your holiday pay because you didn't work your notice. As far as i am aware i am under no obligation to work any notice, as i did not sign a contact and was on casual hours. What are my rights? Surely she can't not pay me holiday pay? Before anyone starts about not working a notice out of kindness, this is in my opinion one of the worst workplaces on earth, the management are ****, the other crew members are ****, mismal pay, need i go on? What i need to know is can she legally withhold my holiday pay? I did not sign any contract.

Answer:
if you work there for more than 90 days a notice is warranted. if you did work a holiday than you should get paid. call the corp office and get answers from the horse. you are talking to the other end of the horse...

Sorry? You have no contract of employment, and you walked out, but you think they owe you something? Aside from being greedy, you did have a contract as soon as you worked your first shift. You've forgotten, or ignored that, but you would not be paid without one. Basically, you did not work your notice, so all your holiday was used up in leau of your notice period. That's the law, they had to employ someone to cover you. Now; just stop being greedy and accept the situation you have made for yourself!

You may not have signed a contract but you had a verbal contract which stands in British law. Employers can withold pay or holidays in lieu of notice. Many do. You could contact ACAS for clarification. UK

Yes they can you did not sign a contract and did not work your notice so they are under no obligation to give you any holiday pay you cant have your cake and eat it.

No they don't owe you anything if you didn't sign a legally binding contract
