Questions concerning car insurance in Quebec?

  • My friend purchased a car from a dealer, he told my friend that he had 48hrs temporary insurance but to get his own asap (they are all closed on the weekend). The dealer parked the car in front of his house in the evening, and my friend decided he would not drive it until he got his own insurance. At 1 am same night we here a huge crash and the car is absolutely destroyed by a completely drunk driver (who was arrested, police report filed etc...). We are now getting the impression that this is not going to be covered, because the "48 hr" insurance the dealer claimed to have is not liable for this? Does anyone know exactly how this works? or is my friend basically screwed into paying for the car even though its going in the scrap yard that he owned for maybe 6 hours? In case this helps... he had a transit plate and he has signed the papers for the car but not actually paid yet.

  • Answer:

Your friend was conned. Your friend shouldn't had let the vehicle leave the dealership until it was properly insured. Used car dealers are in the business of selling cars (by any means necessary), not insuring them. Your friend can try suing the drunk but it may lead to a dead end, however your friend doesn't have many options besides suing the dealer as well.
