What do you do when your thumb joint hurts 2 months after injury?

Its been 5 months since ive injured myself on the job. Am i gonna be compensated.?

  • My workers compensation claim was made in the State of: CAlifornia Im being screwed over, Im 22 and back in december 2011 i was hurt on the job as a truck unloader. I was moving freight from 3 trucks and in the middle of one of them my arm out of nowhere starts hurting so badly it shut down and i could barely move it. I went to the emergency room with my boss and the first diagnosis i was "tendonitis" given was without xrays,nerve studies, or any other proper testings they could find out whats wrong. I've never once been injured before in my entire life, and never had this pain from my elbow. I was given a doctor from my MPN that was quite in blunt wording a "DICK" he kept looking at me when i was explaining my pain like i was retarded, and kept considering me not injured. He was trying to get me studies of my injury that were far out of my reach to make appointments. I am 22 years old and i dont drive due to no one to teach me and i walk everywhere i need to go, the workers compensation insurance company they had appointed me isnt paying for transportation at the time and i was screwed. I had missed one appointment because i didnt have a phone and i had no ride to the hospital to be treated. I was being kicked out of my home and i lost my job. I had nothing, no way to pay for a bus, or a taxi or anything. Than 3-4 months after seeing the appointed doctor i refused to be treated the way he was treating me. He didnt feel like he believed me about my injury. I had told my attorneys assistant i wanted a new doctor because i felt he was giving me a "**** out of luck" treatment. I from day one of the injury until this day am in so much pain i cry at night because my pain is causing great discomfort and stress. He never could tell me what he thought was wrong nor why i was not being contacted for transportation to make the appointments. He denied to give me pain medication, that was the last straw....In the reports he was righting up to give the insurance company i caught ahold of the report and he blamed the issue on my weight, called me a red flag patient and called me a liar. It was so embarrassing to read the things he said while i was in pain seeking a person to help me in my time of need. My lawyer had said we can try Sutter Regional Medical and i was authorized by the insurance company but "TURNED DOWN" to be seen as a patient by their occupational health physician. I at this point felt so depressed, 2 months after the last visit to a doctor i have been told once again of a doctor who has been appointed yet he denies to see me as a patient. I went to the emergency room today because i was crying again due to pain and lack of sleep from the injury and the doctor that seen me today was being a little "RUDE" but had explained to me it didnt show up on the xrays and he didnt expect it to but he believes i have "TENDONITIS" or "TENNIS ELBOW". If any of you know how hard of work it is to be a truck unloader its back breaking work sometimes.....RSI's seem in my experience dealing with it myself is scary. I have had no relief in 5 months and am losing hope. I went months seeing a doctor who never helped me and never had an opinion of my injury and when i see a random guy he tells me he knows what i have and takes an xray on my first visit. I have had no back pay compensation and have not received any compensation what so ever. I cant survive with my injury i cant find work when i know when i lift 5 lbs, hell even a phone my arm hurts severely. Im being forced to crawl my way to live, no income, no clothes, no shelter, nothing. PLEASE GIVE ME HOPE. SOME ADVICE....."I BEG YOU, WHAT CAN I DO?"

    The problem is that you can't prove you were injured on the job. And there is no indication that you actually DID sustain an injury. You are experiencing pain. Nothing happened to explain or justify your pain. Explaining that you don't drive because you don't have anyone to teach you is odd. You don't have any family or friends who drive? You can't go get the DMV book, study and take the written test so you can get a permit. Workman's comp fraud is a HUGE issue. Thousands of fraudulent claims are filed across the country each month. If you are physically unfit (odd, if you have to walk everywhere) and you can't point to something specific that could have caused an injury to you, you should expect a great deal of suspicion.

You seem to be rather an odd person. You somehow objected to the doctor looking at you while he was talking to you - entirely normal and expected in the west. It would have been rude and disrespectful if he had failed to make eye contact. Then you refused treatment from another doctor because you "didn't like" the way he was treating you. A doctor is a trained professional who has spent years studying to achieve his medical qualifications. It is perhaps this behavior that is now the cause of doctors refusing to see you
