    The answer is simple: Neither civil rights or national security is black and white. They are shades of gray and overlap. These concepts, values and programs have to co-exist, like everything in life. In our political system, where one Federal, state or local government program seems to clash with another, the courts rule on what is lawful and Constitutional. The courts have ruled, for example, that the TSA has the right and duty to screen airport travelers. Many persons have sued the TSA, alleging that specific TSA procedures infringe on their civil rights. The courts rule on these challenges as they occur. If the courts find a certain practice is unconstitutional, the TSA must cease and may be required to pay damages. You can find a miliion examples of search procedures that may seem stupid to you - for example, searching a child or an elderly person in a wheelchair. Yet if the TSA fails to search and a terrorist is using such a person to carry explosives without their knowledge, what would happen? And people always feel they are being treated unfairly if TSA rules require certain procedures in certain cases. The courts are the way these problems are resolved. The TSA does its best to stop potential dangers, and it does it with ordinary people making rules and carrying them out. So it is natural that there will be errors, mistakes and perhaps stupid practices. The TSA seeks to train and change unacceptable practices, but they are human and will always be imperfect.
