Should I take a break from gradschool?

Can I make someone take a 1 hour break when they are only scheduled for a half hour break?

  • The person is scheduled 12-7 tomorrow, which is stupid in my opinion. I am going to need the person until 9, for sure. Even the person who made the schedule knows that the schedule 12-7 person will have to stay past 7. Even the scheduled person knows that 7 is too early to go home (she is probably thinking to leave at 8 or so) Anyway, the company doesn't want any overtime at all. Usually, people only take half hour breaks. However, in her case, I want to give her a full hour break and keep her till 9. She always gives me attitude, and if she says no (she won't take a full hour break and/or she won't stay till 9) do I have the right to just send her home on the spot (at 5) AND a basis for disciplinary action

You do have the right to do both. I always try the nice route first. 'Hey, it looks like it's going to be busy all night, is there any chance you could stick around until 9?' And for the break, I would go for, 'Hey, I would really appreciate you taking an hour break today. If you go into overtime the boss will KILL me'. If she refuses, I would call the higher up, if there is one, and make sure its ok to send her home. Then call someone else in that wants the extra hours. Wait for the other person and send her home. I get attitude all the time from my crews, but they all know I do my best to get them out on time.

Yes, you have that right, but instead of taking the confrontational approach, why not find a better solution such as getting the person who does the damn schedule to do it right and avoid this whole mess. Even if that means posting a 12-4; 5-9 split shift showing that she has a full 1h off. If she says she won't work what you need her to, and she refuses to take the break you want her to you can fire her if you like, but for the sake of fairness there are better solutions here. If this was an unforeseen circumstance that's one thing, but you already know you need her so why can't that be conveyed?
