Can my job force me to work hours that I am not available to work?

  • I work at Kroger in the bakery, and I am in the union. My co-worker in the bakery is one our stores union reps and she has something against me, I'm very sure it's jealousy,and she has been trying to get me fired by lying on me to my supervisor and my boss. She got me wrongly sent home yesterday and now I'm filing a grievance against her. I told the female manager what happened because the top store manager didn't even give me a chance to tell my side of the story and she acted like she understood but she went behind my back and told "sandy" that I was filing the grievance and now to get back at me she changed next week's schedule making me close when she and everybody else knows me and my boyfriend just broke up and he left And won't help me with our kids. I have daycare but they are only open until 6 so I am unavailable after 5 because I now have to walk to pick/drop them off since he took his car when he left. I don't have much family and they live all the way in Detroit and I stay in Harrison township which is about 25 miles away and they are in tough situations too so I don't get much help from them. I have no one to watch my kids and they know this so how can they force me to work hours that I am simply not available? They are trying to force me on the schedule hoping I won't show up and they can fire me and this is not right

    When someone pays you to work they decide when, where and how long you work, filing a grievance against a shop steward will not end well for you.

An employer is trying to run a business. To do this he/she needs a certain number of people at certain times. An employee who cannot work when required is not much use to the employer and so at best may get hours cut or at worst terminated.

Unless the union contract speaks to the issue of work hours availability, you can be assigned whatever hours the manager chooses. They don't give a hoot about employees' home situations. "Right" and "wrong" have nothing to do with it. HIre a babysitter.

You're in a tough situation, but sorry, if you can't or won't work the hours they schedule you for, yes they can file you. They don't have to try to work around YOUR schedule.

Yes. Your employer makes your schedule and you work that schedule or you find a new job. File a second grievance claiming retaliation.
