Father not on birth certificate, takes drugs, is unfit, threatening to take me to court for PR...HELP :(?

My son is 8months old, his father takes drugs, drinks and has a daughter from a previous relationship that he never looks after, just sends her off with his family and doesn't bother seeing her, he has never paid for my son or his daughter. We split up just after my son was born as i found out he was still taking drugs (which i thought he had stopped) I let him come and see my son twice a week but wont let him take him away on his own as i don't trust him. He is not on birth certificate and is now threatening to take me to court over PR and getting his name on birth certificate (along with his family threatening violence) What can i do, i don't want him having PR or visitation on his own...please help PS....(i know i messed up, but my son is my world and even though i should never of been stupid enough to have a baby with this 'man', i did and i wouldn't change that as i love my little boy so much).

He doesn't have a chance in hell. There's no need for you to worry. There is so much evidence agaisnt him to not be granted PR that they'll besically just laugh him out of court. As long as you are being the best mum you can be they won't even entertain his case. Plus if he has a criminal record that will go in your favour so if he has one definitely mention it to your solicitor (if he has one, you didn't mention if he did or not but I thought that would be some useful information to help your case). hi, to be honest, everyone makes mistakes and some are worse than others. but some also have good out comes. i should not worry tho, its most certain that you will have full custody of the child.... and once this man is out your life for good you can then concentrate on what really matters, your son... so show him he has the best mum in the world and never stop loving him... hope for all the best :) xxx

His name is not on the birth certificate so in a court of law he has no rights whatsoever so relax :) and good luck!

Actually, the name that is on the certificate really doesn't matter if he takes you to court. They usually will want a paternity test before any proceedings anyway. I really don't think that you have anything to worry about, from the sounds of it, he doesn't do much, and it is a huge hassle taking someone to court. He would have to hire an attorney, which is a BARE minimum of $1,000. (and that is a steal!) He would have to show that he has had an interest in the kid and that you refused. Just keep track of everything... from the dates he requests them and you agree (or disagree), to any proof as to the drug use, threats, etc. ANY amount of money that he provides you, etc. In reality, he can threaten all he wants, but if he actually DID take you to court, it would come out that he doesn't pay child support, and this is a HUGE no-no. especially if you are on any sort of government assistance at all. Just keep track of everything, but don't worry. And just reaffirm to yourself regularly that "Noone can take my blessings from me." and good luck to you! My ex was totally uninterested in our kids until he got a girlfriend who wanted kids. He took me to court (he is wealthy so he spent THOUSANDS on a great ***** of an attorney. Meanwhile, i could only afford much cheaper ones, and he actually won joint custody! Not because he had any good proof or anything negative to say, but because he had always paid support, and i had crap attorneys! Major bummer! so, this stuff DOES happen, but, he is an established businessman, and very pushy and intimidating.) In any case, good luck to you! Just keep reminding yourself that YOU are this baby's mother, and NOONE can change that you are the best parent for them. Don't let any doubt sneak in!
