What to do about a cheating boss stealing hours off paycheck.?

I am pretty sure that my girlfriends boss is cheating her out of a good deal of money. My girlfriend has recently started to work for a day care as a driver, she clocks in and out all day at different times depending on the kids she picks up and there are many variables .. but for some reason.. Her first two pay checks say she worked completely even number of hours... which the way she clocks in and out .. just isn't possible. The first paycheck was for 24 hours exactly.. which seemed strange but we decided to see what her next pay was like.. Her next pay check was 50 hours exactly.. which was missing over six hours by the records she had kept. What makes it even more suspicious is her boss claimed that the machine they use to punch in and out everyday wasn't registering right. The other employees complain of short pay and missing hours on their checks too.. but pretty sure that if asked to they would not help in court.. since most people these days only care about themselves and keeping their job.. So what can she do? Would the records shes been keeping on her hours be enough to go against her boss and her records based off a machine that by her own admission is faulty? But then not sure if she would admit that in court.. But what about the completely even hours for a day care driver, that isn't possible right? so would that be proof that her boss is lying about hours owed?

Definitely exhaust all of your administrative option before taking legal action. First, it's worth asking her boss about the situation. On her next paycheck, have her talk to the boss and simply tell him that she thinks her hours are short. If he does not fix it, it's worth filing a complaint with the proper administrative body in your state. For example in California, the Wage Enforcement Division is part of the Department of Consumer Affairs. Here is the problem though. Fully expect to be fired after filing this complaint. Consider that a blessing You don't want to work for this guy.

Her evidence of hours worked would certainly be considered valid. Tell her to be sure she signs and dates the entries at the end of each day. If this is a small outfit, with no corporate office, all she can do on her own is to speak to her boss. If I were her I'd approach it as if there's been an error and the boss didn't intend to cheat her out of money. I will tell you that lots of time clocks add or take away time on their own. Where I worked before the clock was divided into 15 minute intervals. If you clocked in at 7:05 you got paid like you'd clocked in at 7:00. If you clocked in at 7:07 your time started at 7:15. So consider that before accusing someone of stealing. As sort of a last resort she can call Federal Wage and Hour and complain. Her own documentation will be important if she does that. And trust me, her boss nor the company where she works doesn't want FW&H in their business! It's like the IRS on steroids!
