Lawyer Possibly Using Case as Political Boost?

  • I know this will be a touchy topic because... well, it simply is just that. Nearly 3 years ago, my daughter was nearly killed by a head injury which resulted in her spending over a month in the hospital in recovery. She was in the care of my ex-wife's boyfriend at the time while my ex-wife had gone to work two hours earlier. My ex-wife has had some incidents in the past where one of our children has been hurt, but primarily our youngest daughter who sustained this head injury as well. Most of the previous incidents were passed off as accidental in one way or another. However, over a year later, her boyfriend was indicted for her injuries, accused of intentionally inflicting them (sorry, I'm unsure of the legal terminology, exactly what he is charged with). This was something that was suspected by my family and I, but finally verified, or at least now supported by evidence. This man has had several arrests in the past for various things. His father wasn't around during his childhood because he is serving time in prison for murder, so the "good example" of behavior has been set for this guy. In saying all this, along with the extremely convincing evidence I can't discuss, he looks extremely guilty. His story for how the injury was received is that the child fell backwards from her own height on a carpeted floor. Doctors suggested that her injuries were equivalent to a two-story fall, she had brain injuries, hemorrhaging behind her eyes, and other injuries that suggested a much more forceful impact or shaking. She was 2 years old at the time, and she is also special needs, I only mention this because the patience required to babysit her is higher than for a normal child. All of the above discussion was to keep speculative comments on whether or not this guy looks guilty or not at bay. For the rest of this, please just assume that without a shadow of a doubt, he is guilty. I am fully aware that a person is innocent until proven guilty, and I have no disagreement with that, I just don't want the focus here to be on what might have happened. I live in a small town, known for political corruption and local government easily being manipulated by hiring or talking to the right people. The man who is accused of hurting my daughter, is a National Guard member. He hired the one lawyer that is known locally for getting people out of trouble when they are obviously guilty, but here's the complicated part: This lawyer is also a state senator, so he has his political endeavors to keep in mind. Being a small town, it is no surprise that it is also very "patriotic" and I say that in quotes because I believe it to be blind patriotism, viewing soldiers as something more than human when it comes to crime. My beliefs, or at least my suspicions, are that this lawyer/senator has taken this case to promote his political campaign by "helping a wrongly accused American hero". The only thing is, if you've ever met this "wrongly accused" man, you could see that it is very doubtful he is "wrongly accused" at all. This small town political corruption has been known for fudging facts, paying off individuals to lie, and etc. For example, we have been told that it is likely he will get a medical examiner that is known in certain circles to say anything wanted of him for the right price. I know this probably all sounds over the top, but please, believe me, and trust me that it is very real. I am here because I don't know what else to do. I'm hoping someone out there has some advice for me. Perhaps some way of making sure of a fair trial, and that justice is served for my daughter, or justifiable evidence is presented that proves it was an accident, and not some paid-off medical examiner. I fear what could come of posting this as well, I have taken measures to keep identities secret, but anyone with knowledge of this case can recognize what I've described. Is there anything that can be done? Any hope for justice?

    There is nothing legally wrong with a lawyer taking a case he politically believes in. You seem to think that this is all some grand political conspiracy theory against you based on nothing more than the fact that a lawyer has been hired to represent the person you are filing suit against.
