Whats the Clarification of a USA C1 transit Visa?

  • My Friend is a Mexican National, he applied and recently received a C-1 US multiple transit visa for four years. He is legally residing in the UK as the spouse of a UK citizen. Could someone give me some advice about the following? Can my friend when he reaches Mexico to visit family then ‘re-enter’ the US (as he lives on the Border) with the same visa as long as there is a plane ticket ‘out’ of the US back to the UK? Is a C1 visa essentially one way, (Through and out of the US) in that when he reaches his home country he can’t re-enter unless he applies for another C1 transit Visa? It says he can stay in the US for 29 days, if he visits family in the US for say 20 days, then returns to Mexico for 6 months can he return from Mexico to the UK without the US authorities thinking he has overstayed as he did not leave from the US? Does he have to return to the UK via the US? Essentially he applied for the wrong visa in that case can he ask the US issuing officer to cancel the C1 visa? Can a Person apply for a B2 visa on top of the C1 if they decide to holiday longer in the US than 29 days? He will be applying for UK naturalisation soon, and as he will receive a UK passport. Can he then travel under the US visa waiver scheme as any other Euro national although he has the C1 US visa in his Mexican passport? The info on the US government website is crazy and hard to decipher, Thanks in advance.

  • Answer:

The purpose of a transit visa is the immediate transit through the United States. A Mexican citizen who resides in the United Kingdom can use the transit visa in order to arrive at a U.S. airport and to depart to Mexico on the next connecting aircraft and vice versa for the trip from Mexico to the United Kingdom. A transit visa may not be used for other purposes. If your friend wants to visit friends in the United States he will need to apply for a B-2 visa additionally to the C-1 visa. The maximum length of stay on a transit visa is established at 29 days to enable latin American truck drivers the transit en route to Canada. For how long a transit stay will be granted depends on the decision of a U.S: Immigration Officer at the Port of Entry. If your friend arrives at a U.S. land border with a flight ticket to the United Kingdom valid in 20 days he will most presumably be refused entry and will be told to come back on the day before his flight to the UK.. http://travel.state.gov/visa/temp/types/types_4383.html .. Once he has naturalized and holds a British passport he can seek entry under the Visa Waiver Program for a stay of up to 90 days. He needs an online authorization (ESTA) to visit and to transit the United States. https://esta.cbp.dhs.gov/esta/esta.html ..
