Is the Western Union Blue form available in Malaysia?

My union representative didn't lodge a case form and seek legal advise on my behalf. Can I sue?

  • They told me not to take further action against my employer even though I was being subject to disability discrimination and harassment. I've complained to branch secretary at the union and sent her my case form for her to now seek legal advise on my behalf but I still haven't heard anything. Looks like I've been misrepresented. Can I sue the union for this and /or what action can I take

    (One) of the reasons for being a Trade Union member is that if/when you are in trouble, the Union will provide all the legal representation necessary to fight the case. If on this occasion they have chosen not to, it is probable that the case was either not winnable, or even more likely, there was not a genuine case to answer. By all means ask the Union for the reasons why, but expect to be disappointed.

You could call a lawyer, but it sounds like the union doesn't think you have a disability, or if you do, that your employer's behavior is not harassment. A lot of people have misconceptions about disability law, partly because many employers will do anything to accommodate an employee to avoid a suit. If your employer won't do anything and your union won't do anything, do a little more research and make sure that you have something worth suing for. If you can't or don't want to do that, call a lawyer. If the lawyer says you don't have much of a case, I'd believe him.
