A question concerning Civil and Private Law?

I have a serious question concerning my cousins wife and her father in law!!!!!?

  • My cousins wife has been sleeping with my uncle(his father) and we believe the two youngest children they have together are my uncles. If they do a DNA test will it show who is the father, or is the DNA to close to show a difference. I'm worried for my aunt and cousin they don't deserve to be deceived like this. Please help

  • Answer:

DNA will determine who the father is, but it may not mean anything in the long run - if they were married HE IS PRESUMPTIVELY THE LEGAL FATHER and may be ordered to support the children of his marriage until they're 18 even if DNA proves they're from a third party sperm donor from a relationship outside the marriage.

Really? Instead you would prefer that your cousin abandon his children that he's raised as his? That is what MOST men do when they find out the child is not theirs, or did you not know that? A standard paternity test can often fail to distinguish between brothers, but usually works between other close relatives. I agree that the deception should not continue. May I suggest that you inform both your cousin's wife and your uncle that you are on to them and that either they come clean or you will notify the appropriate parties. You had better be sure of your facts, because you are going to be the bad guy.

DNA will prove it. I would be careful, though, because this is a very difficult problem.
